Before booking with Infinite V Travel & Tours, please take the time to read the Terms & Conditions, as they constitute a contract between Infinite V Travel & Tours and the Client from the time a booking is made. The individual or entity who makes the booking accepts these conditions on behalf of all Travelers in the same booking and is responsible for all payments due. The purchase of travel services from Infinite V Travel & Tours constitutes a contractual agreement and represents the acceptance of the Terms set out herein.
1. INTRODUCTION
Infinite V Travel & Tours is a Philippine-based full-service travel agency duly accredited by the Department of Tourism (DOT) with an address in Taguig City, Metro Manila.
2. DEFINITIONS
For the purposes of these Terms:
“Balance” means the outstanding amount owed by the Client for the booked services, calculated as the total price minus any paid reservation amount or deposit.
“Booking” refers to a reservation or ticket procurement for transportation, accommodation, tours, packages or other travel services secured by the Organizer for the Client.
“Client” refers to the individual or entity assuming responsibility for all payments due for engaging the services of Infinite V Travel & Tours.
“Down Payment” is the initial, non-refundable deposit required upon booking to secure a tour slot, with the remaining balance payable via installments.
“Organizer” (also referred to as either “We”, “Us”, or “Our” in these Terms) refers to Infinite V Travel & Tours.
“Partner” (also referred to as “Supplier”) means any independent third-party operator that fulfills the travel services booked by the Organizer for the Client.
“Reservation Amount” means the initial deposit paid by the Client to confirm a Booking request.
“Service” means the travel planning, booking, facilitation, and advisory assistance provided by the Organizer to the Client.
“Terms and Conditions” (referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between the Client and the Organizer regarding the use of Service.
“Traveler” refers to any individual, passenger, or participant traveling under the Booking made by the Client.
“Website” refers to the Organizer’s official website, infinitevtravel.com.
3. BOOKING CONDITIONS
- To confirm any Booking, a Reservation Amount of either (1) 60% of the total balance or (2) the full flight amount (if a flight is included), whichever is higher, is to be paid upfront at least thirty (30) calendar days before the travel date. This amount is non-refundable once the Booking confirmation email has been sent.
- To reserve a group tour slot via installment plans, a non-refundable Down Payment is to be paid upfront, with each subsequent installment paid on a monthly basis, subject to the Organizer’s terms, until the remaining Balance is fully paid. To confirm Booking of the slot, 60% of the total amount must be settled no less than sixty (60) calendar days before the travel date.
- The required Down Payment amount is set by the Organizer for each travel package or Service, provided that installment availability is expressly stated.
- For travels that are less than thirty (30) calendar days from the date of Booking: Full payment is required within twenty-four (24) hours of Booking. Payments by installment will not be allowed.
- Payments may be settled via online fund transfer, bank deposit, or any method available in our payment gateway. Please be advised that Credit card payments reflect in Our account only three (3) working days after the payment.
- The Organizer will not be responsible for changes in tour package rates due to the dynamic nature of airline fares, hotels, tours, or other services.
- A late payment fee consisting of 15% of the remaining amount applies (for flexible payment options only).
- The Organizer is not responsible for any changes made due to fare jumps, delay in payments, or non-availability of hotel rooms, transfers, tours, or other time-sensitive services.
- The Organizer reserves the right to cancel a Booking and forfeit the paid Reservation amount or Down Payment in case of failure to settle the remaining payable amount on the scheduled due date.
- All payments are coursed only via the Organizer’s company bank account details, through the provided payment gateway.
- The Organizer reserves the right to issue a full refund should, for any technical reasons, We believe that We are unable to fulfil services.
PAYMENT TERMS (FOR TOUR PACKAGES VIA INSTALLMENT PLANS)
- The Down Payment is generally allocated for the purchase of air tickets.
- Full payment of the total Balance is required forty-five (45) calendar days before the travel date.
- Full payment of the total Balance is required for the Organizer to return the Clients’ or Travelers’ passport upon approval of their visa, if applicable.
- For travel to countries requiring a visa, rates are subject to change if the Travelers’ visas are still pending.
- Failure to adhere to these Terms will result in forfeiture of the package and is subject to re-computation.
4. CONFIRMATION
After receipt of Booking request and the appropriate Reservation Amount or upon payment of 60% of the total amount, We will confirm availability of all components with the respective suppliers. After which, a Booking confirmation email will be sent to the Client within one to two business days. Notice will be given to the Client if any of the selected service/s, package, or components is not available, with the option to modify the same.
From Booking confirmation until the final payment, rates may change only if:
1) The Client has requested changes or customizations to the Booking;
2) New or increased government taxes or fees are implemented that apply to the Client’s selected service/s, package, and/or its components;
3) There is an increase in vendor costs applicable to the Client’s selected service/s, package, or its components.
Under any of these circumstances, the Client will be informed how the rates charged for their selected service/s, package, or its components, will be affected.
Rates will not be subject to change once the Booking is fully paid and confirmed, unless:
1) The Client has requested changes or customizations to the Booking; and
2) new or increased government taxes or fees are implemented that apply to the Client’s selected service/s, package, or its components.
5. CANCELLATION POLICY
- Some Services have its own cancellation policies. As such, The Client may refer to their Booking confirmation for specific information on cancellations and refunds.
- If cancelled within 60 – 40 calendar days before the travel date: 50% of the total amount of the Booking will be charged or forfeited to the Client.
- If cancelled within 39 calendar days and below before the travel date: No refunds will be given, unless otherwise specified in the Booking confirmation.
- Refunds may take fifteen (15) working days, subject to the approval of the Organizer, and confirmation of any airline or Supplier involved.
- All cancellations must be made directly with the Organizer, not with any Supplier.
- For hotel Bookings, hotel policies apply. If the hotel in which an accommodation is booked has a no refund policy, there will be no refund in the event of cancellation.
- Hotel extensions, city passes, entrance tickets of any kind, or any similar services, are non-refundable from the moment of Booking, unless otherwise specified.
- Airfare costs or any travel arrangements are non-refundable if any Traveler is not permitted to travel by the Immigration Consulate after airport check-in or is offloaded by any immigration authority.
- Flights are non-refundable and non-changeable if airfare is included in the tour package that has been booked.
- The Organizer can neither provide refunds for portions of trips missed due to cancelled, rescheduled, or delayed flights, nor can it be responsible for additional costs incurred by the Client or Travelers for such reasons.
- Any transfers or activities included in the trip are non-refundable if cancelled within thirty-nine (39) calendar days or below of the travel start date.
- Group tours that fail to reach the minimum number of Travelers required to operate may be cancelled by the Supplier, and the affected Client or Traveler may choose a substitute tour package instead. Additional refunds, if any, will depend on the individual tour operator.
- Should the chosen tour package substitute entail more costs than the original tour package, the Client shall bear the additional costs.
- A service charge of 10% on the total value applies in case of cancellation of land arrangements, provided that the cancellation is made within the allowed cancellation timeframe.
- In the event of a natural phenomenon, force majeure, or government-mandated cancellations, that may lead to trip cancellations, any travel arrangement or Service booked with the Organizer is non-refundable, but may instead be moved on a later date depending on Supplier or Service availability.
6. AMENDMENTS
Confirmed bookings are non-transferable. Likewise, requests to change any name indicated in Bookings or reservations are strictly prohibited and will not be entertained by the Organizer.
Changes to the following constitutes an amendment:
1. Departure date
2. Pick-up time or location
3. Tour or tour type (private or group)
4. Traveler name
5. Itinerary
6. Removing or replacing a Traveler
7. Adding or replacing a Traveler
8. Any situations similar thereto
6(A) AMENDMENTS: BY THE CLIENT
Requests are to be communicated in writing to inquiry@infinitevtravel.com and must be submitted prior to the travel date. Note that acceptance of the amendment is subject to the availability of the airline, hotel, tour operator, or Supplier involved, and is therefore not guaranteed. Processing time likewise varies.
Amended Bookings are regarded as new Bookings. Accordingly, the following rebooking surcharges, whichever applies, shall be settled with the Organizer in order to initiate the amendment request:
- Local Travels: PHP 2,500
- International Travels: PHP 4,800
Payment of the surcharge is not a guarantee that the rebooking is confirmed; it is considered finalized only after the Organizer issues the updated documents or confirmation.
The surcharge is non-refundable once rebooking is initiated, regardless of approval or rejection by the Supplier/s.
Aside from the surcharge, the following costs, to be determined by Supplier rules and availability, are borne by the Client:
1. Airline rebooking penalties
2. Fare difference
3. Tax difference
4. Hotel or land arrangement penalties
5. Supplier-imposed charges
In case the amendment is carried out within the cancellation period, then a cancellation charge applies as if a cancellation was made on the date the request for amendment or change is made.
6(B) AMENDMENTS: BY THE ORGANIZER
Airline seats and accommodation options are subject to availability at the time of confirmation. In case of unavailability in listed hotels, arrangement for an alternative accommodation will be made in a hotel of similar standard.
The Organizer reserves the right to modify itineraries at any point, with notice to the affected Client, due to reasons including, but not limited to:
- force majeure events
- strikes
- fairs and festivals
- weather conditions
- traffic problems
- overbooking of hotels or flights
- flight cancellations or re-routings
- closure of, or entry restrictions, at a place of visit, and et cetera.
The Organizer will do its best to make suitable alternative arrangements. However, it will not be liable for any refunds or compensation claims arising out of the abovementioned occurrences.
6(C) AMENDMENTS: BY THE SUPPLIER OR AIRLINE
- If changes to travel arrangements made with the Organizer are caused by airline schedule disruptions or Supplier-initiated changes, rebooking policies and fees may differ based on their respective policies. Some disruptions may qualify for waived fees and is determined solely by the airline or Supplier on a case-to-case basis.
- In the event of any involuntary flight delay, suspension, or cancellation by an airline, or changes, or cancellations by a Supplier, the Organizer is obliged to notify the affected Client or Travelers of such changes within twenty-four (24) hours after announcement of the respective airline or Supplier, in order to address the affected Clients’ concerns and determine alternative travel dates or arrangements.
- The Organizer shall strive to maintain continuity of the Services availed of by the Client by exerting reasonable efforts within its means or to otherwise process the re-booking or cancellation of Services, with respective refunds, as may be possible, subject to the respective airline or Supplier’s terms & conditions.
7. RATES
- Advertised tour package rates are based on double-occupancy rooms or cabins and the least expensive travel dates, departure city, hotels, and other options available.
- Advertised rates on certain tour packages, flight departures, and services, are generally understood to be valid for a limited time only.
- Existing Bookings for which a Reservation Amount or Down Payment has been received are not entitled to price reductions or discounts that are not available at the time of Booking.
- Rates for services are tentative and may be subject to change without prior notice unless a Booking is confirmed.
8. INCLUDED SERVICES AND EXCLUSIONS
- The Organizer informs the Client of all inclusions and exclusions in their Booking, which varies by package. Any ticket to attractions, rides, museums, safaris, or forms of transport such as train, cable car, ferry, cruise, and et cetera, is not included unless explicitly mentioned as an inclusion.
- Expenses of a personal nature, such as laundry, telephone calls, room service, alcoholic beverages, mini bar charges, tips, portage, camera fees, and et cetera, are not included in all services. Likewise, such expenses are excluded in the pricing of any tour package.
- Unless otherwise noted, the following items are not included in advertised tour package rates:
- Excess baggage and fees;
- airfare;
- entry visa fees;
- optional extensions & excursions;
- personal baggage & travel insurance;
- gratuities;
- beverages;
- items not specifically mentioned in the itinerary or "inclusions" list; and
- any items of a personal nature
9. UNUSED SERVICES
- Unused services, for any reason, are non-refundable during and after the travel. This includes any meal, entrance fee, optional tour, accommodation, transport, and sightseeing, et cetera. No refund can be made for absence by the Client or any Traveler from any part of the itinerary.
- Unutilized nights or early check-outs are non-refundable—hotel policies will apply should either situation arise due to the Client or any Traveler’s medical condition.
10. GROUP BOOKINGS
- A minimum of 20 persons is required for group bookings and tours, except for Europe group tours which can proceed regardless of the number of participants. Failure to meet this requirement may lead to cancellations or re-scheduling. In such instances, the Client may opt to: (1) Choose a different date, or (2) change the itinerary.
- Tickets are booked as a group. Thus, extending stays and choosing airlines are not permitted. Rates are subject to re-computation should the Client otherwise request for such options.
- Clients or Travelers who are denied their visa applications are not entitled to a refund or a rebooking, as the Organizer holds no authority over visa outcomes.
- In some instances, the Supplier may still continue with the group tour even if the minimum number of participants required is not met, subject to revisions as may be necessary.
- All flight details, accommodation, and itineraries shown in group tour package offers are for visa purposes or reference only unless otherwise confirmed.
11. GROUP VISA – FOR CHINA & KOREA TOURS
- In the event of the Suppliers’ inability to issue group visas due to runaway incidents, Clients and Travelers with affected tour dates will have to obtain their individual visas.
- If a tour does not meet the minimum participant requirement, the Client may opt reschedule or re-book for another available departure date.
12. ACCOMMODATION
- All tour packages include carefully selected accommodation options or cruises. Advertised rates apply only to standard double-occupancy hotel rooms or cabins.
- Check-in and check-out times depend on the hotel. Fees for early check-ins or late check-outs may apply and is subject to availability.
- The Client may request a preferred number of beds (one or two) per room or cabin when booking. Single or triple occupancy rooms or cabins are subject to availability. We do our best to accommodate requests but cannot guarantee approval of the same as such matters are at the discretion of the accommodation provider.
- Special requests (beddings, smoking preference, etc.) are subject to availability and approval by the accommodation provider. We curate travel plans with comfort in mind; however, some accommodations may not have air-conditioning, especially in rustic or remote locations, if such options are chosen by the Client.
- Hotels may require an advance or security deposit upon check-in wherein the amount depends on the respective hotel’s policy. This amount is refunded at the time of check out, minus the cost of any items taken from the mini-bar or other charges (e.g. late check-out or any damage done to the accommodation).
- Hotel room allocation is subject to availability and operates on a first come first serve basis.
- Hotels that organize a gala dinner for holiday dates (e.g. 24th December, 31st December, 14th February, and et cetera) may charge clients whose stays fall within the said dates. These fees are paid directly to the hotel.
13. FLIGHTS
- The Organizer only acts as a sales agent for the applicable airline/s. Flight availability and fares are wholly subject to the rules and policies of the airline. Air tickets purchased from Us are subject to the same regulations, policies, and fees that apply when purchasing directly.
- Thus, We are not responsible for the services provided by the airline and any concomitant experiences that occur during the flight.
- The Contract of Carriage in use by the airline/s concerned constitutes the sole contract between the airline and passengers.
- Airlines may change flight schedules at any time without prior notice, even after flights have been confirmed and ticketed—the Organizer is neither responsible nor liable for any costs resulting from a change in airline schedules or missed connections with the flights booked.
- This includes, but is not limited to, fees or penalties incurred for airfare—whether international or domestic—not booked with us; additional accommodations before, during, or after travel arrangements made with us; or any airport transportation not booked with us.
- No alternate flight of the same cost will be provided in the event of an airline-initiated flight cancellation. Additional costs incurred for any amendment or rebooking are borne by the Client.
- Country guidelines may change without prior notice. Hence, it is the Client’s responsibility to stay updated with the latest travel regulations and eligibility on the regulatory website of each respective country or area of travel before traveling.
14. TRAVEL VISAS
- Travel visas are required for certain countries featured in tour packages.
- We only facilitate visa applications for the clients; the authority to grant visas is at the sole discretion of the respective embassy. We cannot be held liable if, for any reason, a visa application is rejected or delayed by the embassy. Any fees paid for the same are non-refundable.
- Minors (children under the age of 18) traveling without parents, with only one parent, or with a parent of a different surname, may be required to provide other documents.
- The Client must bear in mind that some countries require proof of immunization against certain diseases.
15. ENTRY & EXIT FEES
- Countries, borders, airports, or ports may require the payment of entry or exit fees, border crossing fees, or other taxes or fees upon arrival or departure, which must be paid directly by the Client and cannot be included in tour package rates, unless otherwise specified.
- The Client is expected to stay informed of, and is responsible for, the payment of abovementioned fees. In some cases, the same may be paid by credit card, but others may be payable only in cash using USD or local currency.
- The Organizer informs clients of such fees upon Booking or prior to the travel date, but is not responsible for any omissions or errors.
16. TICKETS, TOURS, AND TRANSFERS
- The cost and type of ticket issued to any children included in a travel are based on the age provided at the time of creating the package quote. If the service provider charges extra costs based on height or wrong information as per the child’s passport, the costs are borne by the Client on-site.
- Some tour packages offer a "Land Arrangement only" option without flights to and from the destination. With this option, the Client is responsible for arranging flights, transportation, and other necessary arrangements to the package star ng point.
- For Land Arrangement Packages, the Client will be asked to provide their flight details for our team to track the flight/s for purpose of airport transfers, if applicable.
- Private airport transfers are available at an additional cost and may be requested before the final payment is due.
17. GROUP PARTICIPATION
- Group tours are composed of people of different backgrounds and nationalities, especially in a foreign country. To avoid discord within groups and to provide our Client and Travelers with a positive touring experience, the Organizer and Suppliers reserve the right to reject or remove any Client and Traveler whose behavior is determined to be incompatible with the group.
- Behaving in a way that is judged to cause or is likely to cause danger, distress, or material annoyance to others, interfering with the wellbeing or mobility of the group, failing to comply with the decision of the tour manager, and/or is deemed to be fractious to the group, may lead to the Client and/or any Traveler being asked to leave the tour.
- In such cases, any portion of the package cost is non-refundable; the Client will bear all expenses incurred from the termination of the touring program.
- In certain circumstances, We may elect not to serve the Client on any future trip.
18. INFORMATION & PRIVACY
- For Booking, the Client is expected to provide certain personal information, including the full legal name, gender, birthdate, and passport information for each Traveler as required by law or reasonably required to enable Us and Our suppliers to provide the purchased travel services.
- The Client’s contact information, including address, active phone number, and email address, is also required. All other Travelers will be asked to provide their respective phone number and email address for communication and information dissemination purposes in case of last-minute itinerary changes or emergencies.
- The Client and all other Travelers is expected to designate an emergency contact person who is not traveling and likewise provide pertinent contact information of the same.
- The Client is responsible for verifying that any information provided for themselves and on behalf of other Travelers in the same Booking is complete and accurate. Under no circumstances will the Organizer be liable for any errors or omissions in the information provided by the client and other traveling companions, or for any fees or damages arising from and/or related to such errors or omissions.
19. PASSPORT
- All Clients and Travelers traveling internationally should have passports valid for at least six (6) months after the date of return (longer for some destinations). Otherwise, entry may be denied for failure to comply.
- It is the Client’s responsibility to ensure that all other Travelers have a passport with at least six (6) months validity from the date of travel.
- The Client and all other Travelers’ names must be provided exactly as they appear on their passport, including titles such as Jr. or Sr. and any multiple first, middle, or last names.
- Any unrectified errors prior to travel that could prevent the Client and any other Traveler from boarding their respective flight/s, or entry into countries, may require the purchase of new air tickets, for which the Organizer can neither be held liable nor provide a refund.
20. LOCAL LAWS
During travels, the Client and all Travelers are expected to comply with the laws and regulations of all places of visit.
Committing any illegal act may result in removal from the tour group, if applicable, and may be subject to fines or punishment by local authorities, for which the Organizer will not be held responsible.
21. IMAGES & MARKETING
While participating in any of Our Services, images, photos, or videos may be taken by representatives, contractors, or other authorized participants. The Client or other Travelers may consent to any such pictures or forms of media featuring them.
Consent will grant a perpetual, royalty-free, and worldwide license to the Organizer, its contractors, and assigns, to reproduce the said media strictly for purposes of marketing, promotions, and creation of promotional materials only, in any medium whatsoever, without any further obligation or compensation payable to the Client or Traveler.
22. TRAVELERS WITH DISABILITIES
- The Client must notify the Organizer of the particular needs of, or assistance in travel required for themselves or any Traveler at the time of Booking.
- We will make reasonable attempts to accommodate the Client’s needs and to notify the airline and other concerned Partners of said requirements.
- However, We cannot guarantee that all disabilities or difficulties can be accommodated, especially in foreign countries and remote locales. We cannot provide individual assistance for walking, dining, entering and exiting motor coaches, ships, and other transportation vehicles, or to assist with other personal needs. The Client or any other Traveler requiring such assistance must be accompanied by a paid qualified companion.
- Our itineraries often feature sightseeing and other activities which may involve strenuous activities such as hiking moderate distances, walking up steps or over uneven surfaces, ascending to high elevations, or traveling in small boats.
- In general, travel conditions in some countries may be more difficult than what the client is accustomed to, for which We are explicitly released from liability in the event of any injury, accident, loss, damage, or expense arising from failure of independent Suppliers to provide accessible facilities.
23. ACCEPTANCE OF RISK
- The Client and all Travelers acknowledge that travel, especially to foreign and remote destinations, may involve some risk to health and safety. The degree and nature of personal risk involved depends on the products or services booked and the locations in which a product or service operates.
- There may be a significant degree of personal risk involved in participating in physical and/or high-risk activities (such as ziplining, snorkeling, or hot air balloon rides), carriage by watercraft, or traveling to high altitudes, remote locations, or countries with developing infrastructure.
- Standards of hygiene, accommodation, and transport in certain destinations may be lower than the standards clients are accustomed to, and there may be a risk of food poisoning, disease, or injury.
- Luggage and personal belongings are at the Client and Traveler’s risk. The Organizer is not liable for any loss, damage, delay, or theft occurring in airlines, hotels, or other third-party transit providers.
- By Booking with Us, the Client acknowledges that they have considered the potential risks, dangers and challenges, and personal capabilities and needs, and assume responsibility for all such risks. Moreover, the Client and Travelers agree to take all prudent measures in relation to their safety while traveling, including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices, and helmets) and following all posted signs and oral or written warnings regarding health and safety.
- The Organizer operates exclusively as a travel facilitator and is neither a common carrier nor a direct service provider of any transportation, lodging, or hospitality services.
- Absent any negligence, Us and Our representatives will not be held liable for any claims or causes of action arising from any losses, damages, injuries, or death resulting from failure to comply with safety instructions, warnings, or the risks inherent in travel and participating in adventurous activities included in the Client’s selected itineraries or otherwise offered by Us or Our representatives.
24. GOVERNING LAW
The laws of the Republic of the Philippines shall govern these Terms and the Client’s use of Our Service. The courts of the Republic of the Philippines shall have exclusive jurisdiction over any claim arising out of the same.
25. DISPUTE RESOLUTION
If a client has any complaint or seeks to dispute a Service, the Client agrees to resolve the dispute by first contacting the Organizer.
26. CHANGES
We reserve the right to update or alter these Terms at any time. We will post amendments to these Terms on Our Website, and any amendment will take effect immediately upon posting.
27. ENFORCABILITY
The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision stated herein.
If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable.
28. ENTIRE AGREEMENT
These Terms represent the entire agreement between Client and the Organizer. There is no additional liability.
